For Respondent(s):
Dr.R.Gouri, Government Counsel For R1 & R3 Mr. C.Kathiravan, Standing Counsel For R2 Order (Order of the Court was made by S.M.Subramaniam J.) The present review application has been instituted seeking review of the order dated 10.05.2024 passed by this Court in WA No.2654 of 2023. 2.
The grounds raised in the review proceedings would show that an attempt has been made to re-adjudicate the grounds raised in the writ proceedings. The power to review is different from appellate power and is subject to the following limitations to maintain the finality of judicial decision:- (a) The review proceedings are not by way of an appeal and have to be strictly confined to the scope and ambit of order 47 Rule 1 of CPC (b) Review is not to be confused with the appellate powers, which may enable an appellate Court to correct all manner of errors committed by the subordinate Courts.
(c) In exercise of the jurisdiction under Order 47 Rule 1 of CPC, it is not permissible for an erroneous decision to be reheard and corrected.
3.
In a review petition, it must be remembered that the purpose is limited and it cannot be allowed to be disguised as an appeal. The said legal position has been reiterated by the Constitutional Courts time and again and in the present case, the petitioners have raised grounds in the review application for re-adjudication of the merits already considered by this Court. Thus, this Court does not find any merit in the review application and consequently, the application stands dismissed. No costs. Consequently, the connected Civil Miscellaneous petition stands closed.
