Criminal Original Petition filed under Section 482 Cr.P.C. praying to call for the records in C.C.No.368/2013 pending on the file of the Judicial Magistrate No.II, Thiruvannamalai, Thiruvannamalai District quash the charge sheet. ORDER

This petition has been filed to call for the records in C.C.No.368/2013 pending on the file of the Judicial Magistrate No.II, Thiruvannamalai, Thiruvannamalai District quash the charge sheet.

2. The learned counsel for the petitioner would submit that the allegations made against the petitioner are totally false and he has been implicated in this case only on suspicion. Hence, he has filed this petition.

3. The learned Additional Public Prosecutor would submit that the petitioner / husband is the single accused in the case and there are specific allegations against him. He further submits that there are 14 witnesses in this case and the trial court is proceeding with the trial.

4. On perusal of charge sheet, it is found that there are specific averments and allegations as against the petitioner as such they attract the offences in the charge sheet. Therefore, this Court is not inclined to entertain this petition. However, considering the case is of the year 2013, the learned Judicial Magistrate No.II, Thiruvannamalai, Thiruvannamalai District is directed to complete the trial proceedings in C.C.No.368 of 2013 within a period of three months from the date of receipt of a copy of this Order.

5. With the above direction, this Criminal Original Petition is disposed of. Consequently, connected miscellaneous petitions are closed.
