ORDER

This Criminal Original Petition has been filed seeking a direction to the second respondent to register a case on the complaint dated 30.06.2016 in CSR.No.262 of 2016 on the file of the 2nd respondent and to investigate into the matter.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. When the matter was taken up for hearing, the learned Additional Public Prosecutor submitted that, on the complaint dated 30.06.2016, given by the petitioner, petition enquiry is pending in CSR.No.262 of 2016 before the second respondentpolice. https://hcservices.ecourts.gov.in/hcservices/

4. Recording the submission of the learned Additional Public Prosecutor, the petitioner is directed to co-operate with the respondent-police for enquiry and the respondent police is directed to conduct enquiry expeditiously and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, following the decision laid down by the Hon'ble Supreme Court in Lalita Kumari v. Government of Uttarpradesh and Others reported in (2014) 2 SCC 1, otherwise the petition may be closed under intimation to the petitioner. With the above direction, this Criminal Original Petition is closed.
