The petition is filed by the accused in STC.No.3331 of 2022 on the file of the learned Judicial Magistrate-II, Puducherry. Aggrieved by the 1/3

order passed by the trial Court allowing the petition under Section 311 of Cr.P.C filed by the complainant, the present criminal original petition is filed.

2. Reading the impugned order and the grounds that the petition challenged the impugned order, this Court finds that pending trial, the complainant has taken out an application for production of his bank account to prove the source of money. The trial court after considering the facts of the case and the defence taken by the accused had felt the necessity for summoning the document which will be helpful to arrive at just decision of the case. This Court does not find any illegality in the order passed by the trial Court. Hence, this Criminal Original Petition is dismissed. Consequently, the connected miscellaneous petition is closed. Vv 20.11.2023 To 1.The Judicial Magistrate-II, Puducherry.
