Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the first respondent to consider the petitioner's representation dated 24.12.2013 and pass orders on the same with regard to illegal promotion order issued by the Madurai Corporation Commissioner in Pro.No.Ma.Ni.1/16466/2013, dated 21.12.2013.

The petitioner has filed this writ petition seeking direction to the first respondent to consider the petitioner's representation dated 24.12.2013.

2.The case of the petitioner is that he was appointed as Bill Collector on 28.06.1986 and was promoted as Assistant on 18.08.2010. According to the petitioner, the third respondent issued promotion order dated 21.12.2013 to ineligible persons, which compelled him to make representation to the first respondent seeking to set aside the said promotion order, but his representation was not considered. Hence, this writ petition.

3.Today, when the matter was taken up for consideration, the learned counsel appearing for the petitioner submitted that the petitioner would be satisfied if liberty is given to him to challenge the promotion order issued by the Madurai Corporation Commissioner in Pro.No.Ma.Ni.1/16466/2013, dated 21.12.2013. 4.In view of the above, this writ petition stands disposed of granting such liberty to the petitioner. No costs.
