ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 294(b), 323, 324 and 506(ii) of IPC, in Crime No.172 of 2022, on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that the defacto complainant and the petitioners are neighbours. Due to some previous enmity, wordy quarrel arose between them, due to that, the petitioners have abused and assaulted the defacto complainant and thereby, he has sustained injury. Hence, the complaint.
3. The learned Counsel for the petitioners would submit that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution and a false case has been foisted against them. Hence, he prays for grant of Anticipatory Bail to the petitioners.
4. The learned Additional Public Prosecutor would submit that it is a case in counter and the victim got severe head injury and he is still in hospital and further the petitioners A1 and A2 are having three previous cases pending against them. Therefore, he vehemently opposed to grant anticipatory bail to the petitioner.
5. Taking into consideration of the facts and circumstances of the case and also the fact that there are three previous cases as againt the petitioners, the custodial interrogation of the petitioners are very much required, this Court is not inclined to grant Anticipatory Bail to the petitioners.
