Respondents Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the 4th respondent herein to dispose the Industrial Dispute filed by the petitioner as acknowledged by the 4th respondent vide notice No.M.8/8/2015-B3, dated 19.02.2015, pending on the file of the 4th respondent within time frame fixed by this Honourable Court. For Petitioner : Mr.A.Edwin Prabakar For Respondents : Mr.Su.Srinivasan, Assistant Solicitor General
ORDER
Heard Mr.A.Edwinprabakar, learned counsel for the petitioner and Mr.Su.Srinivasan, learned Assistant Solicitor General, who accepts notice for the respondents and with the consent of parties, the writ petition itself is taken up for final disposal.
2. The petitioner in this writ petition seeks for a writ of mandamus to direct the 4th respondent herein to dispose of the Industrial Dispute raised by the petitioner, now pending on his file for conciliation.
3. The only grievance of the petitioner is that an early decision has to be arrived at in the matter, since the petitioner is attaining the age of superannuation in 2017. The petitioner, in the affidavit, filed in support of the writ petition, has stated that the last hearing date was fixed on 10.4.2015 and he appeared for the hearing, but however, the Assistant Labour Commissioner, (Central) was on leave and the petitioner was informed that they will intimate the next hearing date. However, till date the petitioner has not received any such communication.
4. This Court is not going into the allegations made out by the petitioner and only proposes to direct the fourth respondent to conclude the proceedings at the earliest, as the writ petition is disposed of at the admission stage waiving notice to the respondents.
5. Accordingly, the writ petition is disposed of by directing the fourth respondent to intimate the next hearing date to the petitioner and endeavour to pass an order at the earliest, preferably within a period of three months from the date of receipt of a copy of this order.
