Application has been filed by the plaintiff in the suit seeking permission to file additional documents.

2.These documents are an electronic mail sent by the second defendant to the first defendant on 27.09.2017 and a report regarding the account statement. 3.The matter came up earlier. I had the benefit of hearing the learned counsel for the respondent also. However, it was found that necessary affidavit under Section 65(B) of the Evidence Act, 1872 had not been annexed. 4.Today, the learned counsel for the plaintiff had produced such an affidavit. It had been sworn by Mr.Manmohan Gupta/Managing Director of the Plaintiff Company.

pam 5.The veracity of the affidavit and the veracity of the documents and their relevancy can be decided only during the trial. Keeping all those issues open, subject to admissibility, relevancy and proof of the documents in manner known to law, the application is allowed.
