Petition under Article 226 of the Constitution of India praying for issue of a Writ of Mandamus directing the 2nd respondent to survey the land of the petitioner comprised in Survey No.29/4, Mangkulam Village, Veppur Taluk, Cuddalore District, measuring an extent of 3 1⁄2 cents by measuring the boundaries as per sale deed dated 31.08.1964 and also to issue a separate patta to the land in favour of the petitioner by considering the representation of the petitioner dated 12.08.2015.

Mr.V. Subbiah, learned Special Government Pleader takes notice for respondents. By consent, the main writ petition itself is taken up for final disposal.

Based on the sale deed dated 31.08.1964, the petitioner has submitted a representation to the 2nd respondent dated 12.08.2015 seeking to survey the land comprised in S.No. 29/4, Mangkulam Village, Veppur Taluk, Cuddalore District and also for issuance of separate patta as against the joint patta issued in respect of the said land. As the said representation is yet to be disposed of, the petitioner is before this Court. https://hcservices.ecourts.gov.in/hcservices/

Since the representation of the petitioner, with regard to the relief sought, is pending before the 2nd respondent, direction is issued to the 2nd respondent to consider and pass appropriate orders on the said representation of the petitioner dated 12.08.2015, within a period of six weeks from the date of receipt of a copy of this order, after affording an opportunity to the petitioner as well as to third parties, in whose name, the joint patta stands. The writ petition is disposed of accordingly. No costs.
