C.M.P.No.3389 of 2016 in SECOND APPEAL No.1329 of 2005 T.MATHIVANAN, J Heard Mr.T.R.Rajaraman, learned counsel appearing for the petitioner.

2. This petition is filed to reconstruct the papers in the M.P.No.SR.No.76766 of 2013 filed on 29.08.2013.

3. It appears that as per the information available in the system, C.M.P.No.SR.No.76266 of 2013 was filed on 29.08.2013 and it was returned to rectify certain defects on 23.09.2013 and it still remains unrepresented. As the counsel for the appellant was not able to trace the above unnumbered petitions, as stated in the affidavit filed in support of this petition, the petitioner has come forward with this petition.

4. Having regard to the reasons assigned in the affidavit filed in support of this petition, this Court is of the view that the M.P.No.SR.No.76766 of 2013 may be ordered to be re-constructed.

5. In view of the above, this petition is allowed and the Registry is directed to reconstruct the records.
