ORDER

This Criminal Original Petition has been filed directing the Judicial Magistrate Court No.1, Mettur for speedy disposal of the case in C.C.No.54 of 2009 as expeditiously as possible within the stipulated time prescribed by this

Hon'ble Court.

2. The learned counsel for the petitioner submitted that C.C.No.54 of 2009 is pending on the file of the learned Judicial Magistrate I, Mettur, without any progress. The petitioner is one of the accused in this case. He is unnecessarily made to appear before the Court without any progress in the case.

3. In response, the learned Government Advocate (Crl.Side) submitted that the case is pending for receipt of records.

4. Considered the rival submissions and perused the records.

5. A perusal of the case status filed in connection with this case shows that there was a stay in C.C.No.54 of 2009 from 25.09.2017 to 28.05.2018. When the case was pending for recording evidence, from 06.05.2019, the case was pending for receipt of records (awaiting records). It is not known whether the records submitted had been received. Therefore, the Judicial Magistrate Court No.1, Mettur is directed to take effective steps for getting records, if it is submitted before the Sessions Court or High Court and proceed to dispose of

the case as expeditiously as possible.

6. With the above directions, this Criminal Original Petition is disposed of.
