Respondent(s) PRAYER The Writ Petition is filed under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus directing the Respondents 2 and 3 to issue caste / Community certificate to the petitioner sons namely M.Rohit Varma and M.Sanjai Varma for the Community Vanniyar- (Most Backward Class) on the basis of the petitioner/ mothers caste/ community, origin at Puducherry, in pursuant to the orders of this honble court passed in W.P. No. 23638 /2023, dated 09.10.2023.

ORDER

(Order of the Court was made by J.NISHA BANU, J.) The present Writ Petition is filed for the issuance of a Writ of Mandamus directing the Respondents 2 and 3 to issue caste / Community certificate to the petitioner's sons namely, M.Rohit Varma and M.Sanjai Varma for the Community Vanniyar - (Most Backward Class) on the basis of the petitioner/ mother's caste/ community, origin at Puducherry, in pursuant to the orders of this Court passed in W.P. No. 23638 /2023, dated 09.10.2023.

2. It is the case of the petitioner that the petitioner belongs to Vanniyar Community and she married one Manimaran, who belongs to Scheduled Caste and the said marriage is an inter-caste marriage. The petitioner and her husband are origin of Puducherry and they have two children and the first son is studying in 11 th standard and the school authorities, as such, are insisting for community certificate. Hence, the petitioner had approached the respondents 2 and 3 for issuance of a community certificate to her sons, following her caste and community. In this regard, she had also made a representation to the second respondent on 30.07.2024, but, the same has not been considered. Hence, the present Writ Petition is filed.

3. Mr. V.Vasanthakumar, learned Additional Government Pleader (Pondy) submits that till date, the petitioner has not filed any application for issuing a Community Certificate. If an application is filed by the petitioner, the same will be considered.

4. Heard the learned counsel appearing for the petitioner as well as the learned Additional Government Pleader (Pondy) appearing for the respondents.

5. Considering the facts and circumstances of the case, this Court directs the petitioner to file an application before the respondents for issuing the Community Certificate along with a copy of this order, within a period of two

(2) weeks from the date of receipt of a copy of this order. On such application is filed by the petitioner, the respondent Nos.2 and 3 shall consider the same and pass orders, on merits and in accordance with law, within a period of twelve

(12) weeks thereafter.

6. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
