At the hearing on 29.07.2022, it was recorded that notice was served on the proposed third defendant on 22.07.2022. In order to provide a further opportunity to the proposed third defendant, the matter was listed today. There is no representation for the proposed third defendant at the hearing today. Therefore, the application to implead the proposed third defendant is taken up for hearing. Learned counsel for the applicant / plaintiff states that the second respondent / defendant stated in its counter that it manufacture products bearing the impugned mark for and on behalf of the proposed third defendant.

2. Upon considering the above submission, the proposed third defendant is a necessary party to this action. Accordingly, the impleading application is allowed. As a corollary, the plaintiff is permitted to carry out amendments in the plaint on or before 16.08.2022 and serve a copy of the amended plaint on the defendants within a week thereafter.

3. List the matter on 16.08.2022.
