O R D E R

This Writ Petition has been filed to issue a Writ of Mandamusto direct the third respondent to provide police protection to the petitioner and his workers while constructing the compound wall around his land measuring 0.31.00 hectares comprised in S.No.45/2A, Panamarathupatti (Kallavi) Uthangarai Taluk, Krishnagiri District.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent- Police and perused the materials available on record.

3. On a perusal of the complaint made by the petitioner before the respondent police and the affidavit filed in support of the petition, it is seen that the dispute between the parties is civil in nature. The Writ Court cannot conduct a roving enquiry and find out the correctness of the right and interest over the property. This Court is not inclined to grant the relief as sought for by the petitioner in this writ petition. However, the petitioner is at liberty to work out his remedy before the competent Civil Court.

4. With the abovesaid direction, this Writ Petition is dismissed No costs.
