Heard Mr.S.V.R.Ramprasad, learned counsel appearing for the applicant, who also happens to be a Co-Trustee of Rajah Sir Ramaswamy Mudliar Choultry Trust Estate (RSRM Trust Estate). 2.The prayer sought for in the application is to grant permission to the Administrator General and the Official Trustee (AG & OT) for payment of Rs.1,00,000 (Rupees One Lakh only) favouring, Sri Kulachirai Nayanar Arakattalai, A/c No.6195445375, Indian Bank, IFSC Code: IDIB000M012, Manamelkudi Branch, Pudukottai District, from and out of the funds of RSRM Trust Estate.
3.Perused the averments set out in the affidavit filed in support of the application.
4.The Official Trustee has filed a report stating that in the recent passed, the Official Trustee has donated to the Guru Pooja Vizha either on application filed by the Official Trustee or by the said Co-Trustee, the applicant before this Court and during 2020, as per the orders of this Court in Application No.2724 of 2020, dated 10.12.2020, a donation of Rs.1,00,000/- was given for the Guru Pooja Vizha. 5.From paragraph 3 of the report filed by the Official Trustee, it is seen that the funds position of the RSRM Trust Estate is quite comfortable. The Official Trustee would state that he may be permitted to donate a sum of Rs.50,000/- (Rupees Fifty Thousand only).
6.Mr.E.V.R.Chandru, learned counsel appearing for the AG & OT pointed out that from and out of the RSRM Trust Estate's funds, more than a sum of Rs.3.50 Crores has been spent for various charitable purposes and also for helping the State Government during the pandemic by donating to the Tamil Nadu Government Chief Minister's Relief Fund.
7.Thus, considering the activities done by the RSRM Trust Estate, a direction is issued permitting the Official Trustee to donate a sum of Rs.50,000/- (Rupees Fifty Thousand only) towards Kulachirai Nayanar Guru Pooja Vizha by issuance of Reserve Bank of India (RBI) cheque. 8.It is submitted by Mr.E.V.R.Chandru, learned counsel for the AG & OT that on account of the recent circular issued by the RBI, unless and until an account is opened in the State Bank of India, payments cannot be effected. Therefore, the Organisation, which is going to conduct the Anna Dhanam festival during the Guru Pooja Vizha, shall proceed to do so and the sum of Rs.50,000/- shall be donated by the Official Trustee from the funds of the RSRM Trust Estate to the said Organisation, after complying with the procedures in terms of the direction issued by the RBI. 07.09.2021 Note: Issue order copy on 08.09.2021 abr
