Respondents Prayer:- Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure to direct the 1st respondent to execute the Non-Bailable Warrant against the 2nd respondent/1st accused Kavin Vivekanandan and to secure Vivekanandan, 3rd respondent/2nd accused before this Court as expeditiously as possible to secure the ends of justice. ORDER
Seeking a direction to the 1st respondent to execute the Non-Bailable Warrant against the 2nd respondent/1st accused Kavin Vivekanandan and to secure Vivekanandan, 3rd respondent/2nd accused before this Court as expeditiously as possible to secure the ends of justice, the petitioner has come up with this petition.
2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the 1st respondent and perused the material placed on record.
3.The learned Additional Public Prosecutor submitted that on 02.07.2015, the accused in this case have surrendered before the concerned Court.
4.Today, Mr.C.Ramalingam, Inspector of Police, V-5, Thirumangalam Police Station, Anna Nagar, Chennai, has filed
a status report, wherein at Paras 5 and 6, he has stated as follows:
"5.I submit that on 02.07.2015, Kavin Vivek(A-1) surrendered before the X Metropolitan Magistrate Court, Egmore, Chennai and on the same day, he was released on bail with the condition that he shall appear before the said Court on every Monday.
6.I submit that on 26.06.2015, Kavin Vivek (A-1) & Vivekanandan(A-2) filed Anticipatory Bail petition before this Hon'ble Court in CrlOP.No16044 of 2015 and A-2 obtained anticipatory bail on 02.07.2015 with the following conditions:
7.Accordingly, the 2nd petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned X Metropolitan Magistrate, Egmore, Chennai, within a period of 15 days from the date of receipt of a copy of this order, on his executing a bond for a sum of Rs.10,000/- with two sureties, each for a like sum to the satisfaction of the learned Magistrate concerned or to the satisfaction of the respondent police or the police officer who
intends to arrest and on further condition that the petitioner shall appear before the trial Court for all further hearings without fail."
5.In view of the above, nothing survives in this petition and accordingly, this Criminal Original Petition is closed with liberty to the trial Court to proceed further in accordance with law.
