Mr.C.Jayaprakash (R1 to R3) Government Advocate Mr.S.Sithirai Anandam (R4)
ORDER
The petitioner is the Indira Gandhi Jeyanthi Memorial Educational Cultural and Charitable Trust, which claims to be managing educational institutions.
2. The petitioner has, thus far been providing education to female students from the lower economic strata. It now desires to open its doors to male students as well. An application was made on 17.06.2020 to R1 seeking to change name of the college such that it includes the word 'co-education' therein, seeking approval for admission to male students.
3. While there has been some progress in that the application has moved from one official to another, there has been no finality reached, paving the way for this writ petition, wherein the petitioner seeks a mandamus directing R1 and R2 to consider its representation and to permit it to run the educational as a co-educational institution.
4. Mr.C.Jayaprakash, learned Government Advocate, accepts notice for R1 to R3 and Mr.S.Sithirai Anandam, learned counsel, accepts notice for R4. Both are armed with necessary instructions to enable a 2/5
final disposal of this matter now.
5. While Mr.C.Jayaprakash, would agree that the application would be disposed in accordance with law and extant rules and regulations within a period of four weeks from date of receipt of a copy of this order, learned counsel for R4 would only plead that there should be no admission of male students by the institution, till the application is decided. This is a reasonable request which this Court accedes to.
6. Hence mandamus is issued to official respondents / R1, R2 to dispose application of the petitioner dated 17.06.2024, after hearing the petitioner and in accordance with law and all applicable rules and regulations, within a period of four weeks from date of receipt of a copy of this order and admit male students to the institution subject to the result of the application.
7. Writ petition stands disposed in terms of this order. No costs. Connected miscellaneous petition is closed.
