ORDER

This petition has been filed seeking a direction to the respondents to register a complaint based on the petitioner's representation dated 10.04.2026.

2.The contention of the petitioner is that he previously lodged a complaint to the third respondent and no action has been taken. Subsequently, the petitioner sent a representation to the Commissioner of Police, but there too no action has been taken. The petitioner has been running from pillar to post to initiate legal action and recover the petitioner's gold jewels weighing more than 2kg. Hence, the present Petition has been filed. 3.The learned Additional Public Prosecutor submitted that the petitioner lodged a complaint to the third respondent stating that Feroz Malik and Cream Mandel who were employed in his shop and one Parveen Rajput with whom he had placed orders received gold bars totalling 2109.970 grams but failed to return the finished jewels. During enquiry, it was found that the value of the lost property exceeds Rs.

3 crores. The Inspector of Police is in the process of requesting the Assistant Commissioner of Police to transfer the file to the file to the Central Crime Branch. This process involving the Assistant Commissioner and the Deputy Commissioner in transfer of file to the CCB has resulted in the current delay.

4.Considered the submissions and perused the materials available on record.

5.It is seen that the petitioner's complaint is currently with the Assistant Commissioner, Flower Bazaar Police Station. The Deputy Commissioner of Police's office is also situated within the same compound. In view of the gravity of the matter, the third respondent is directed to transfer the entire case file of the petitioner through the proper channel to the Deputy Commissioner of Police, Central Crime Branch, within a period of two weeks from the date of receipt of copy of this order. Upon receipt of the file, the Deputy Commissioner of Police, CCB, shall assign the case to an appropriate team to conduct an enquiry. If a cognizable offence is made out, register a case and proceed in accordance with law without further delay. The entire process must be completed within a period of two months.
