This Application has been filed to condone the delay of 10 days in filing the above captioned C.M.A against the decree and judgment passed in MACT.O.P.No.120 of 2019 dated 07.03.2022 on the file of the Motor Accident Claims Tribunal, Sub Court, Paramathy. 2.Notice to the 2nd respondent is dispensed with and the learned counsel for the appellant has also made an endorsement to that effect, since, he remained absent before the Tribunal. Though notice was served on the 1st respondent, he had neither chosen to appear in person nor through his advocate.

3.Heard the learned counsel appearing for the petitioner. 4.Considering the averments made in the affidavit filed in support of this application and being satisfied with the same, the delay is condoned. Hence, this application is ordered as prayed for. 5.Registry is directed to number the C.M.A., if it is otherwise in order and the list the same in due course.
