This petition has been filed to cancel the anticipatory bail granted to the first and second respondents by this Court in Crl.O.P.No.14718 of 2022 by an order dated 27.06.2022. 2.

Heard both sides.

The petitioner is the defacto complainant. The respondents 1 and 2 are A1 and A2. The petitioner lodged a complaint alleging that the respondents 1 and 2 are in due of balance amount of Rs.14,53,208/-. They paid only a part of the amount during business transaction. While filing anticipatory bail before this Court, the respondents 1 and 2 had stated that already a Civil Suit is pending. However, no suit is pending and on false submission, they obtained anticipatory bail. Considering the facts and circumstances, this Court granted anticipatory bail on condition that the first respondent herein shall appear before the respondent Police daily at 10.30

a.m for a period of two weeks and thereafter as and when required for interrogation and the second respondent herein shall appear before the respondent Police as and when required for interrogation.

4. Though no suit is pending between the petitioner and the respondents 1 and 2 herein, it is a business transaction and in fact, a part of the amount has been paid by the respondents 1 and 2 and for the remaining amount, the present FIR has been registered.

5. Therefore, the custodial interrogation of the respondents 1 and 2 herein do not require in this case. That apart, as directed by this Court, the respondents 1 and 2 were duly complied with the conditions imposed by this Court.

6. Considering the above facts and circumstances, this Court finds no grounds to cancel the anticipatory bail granted to the respondents 1 and 2 herein and this Court is not inclined to cancel the anticipatory bail granted to the respondents 1 and 2.

Accordingly, this criminal original petition is dismissed. However, the third respondent is directed to complete the investigation and file a final report, within a period of eight weeks from the date of the receipt of a copy of this Order.
