The learned counsel for the petitioner submitted that the petitioner would restrict his prayer to the effect that the Trial Court should be directed to frame an issue with regard to absence of cause of action for filing the suit in respect of prayer "A".
2. I have also heard the learned counsel for the respondents.

3. The petitioner, in his written statement has taken up a contention with regard to the absence of cause of action for filing the suit in respect of prayer "A". Therefore, necessarily, an issue to that effect shall be framed by the learned Trial Judge.
