O R D E R

This petition has been filed seeking direction to the respondents not to harass the petitioner and his family members under the guise of enquiry.

The learned Government Advocate on instructions, submitted that there are nearly 42 cases pending against the petitioner.

The learned counsel for the petitioner submitted that the respondent Police is not allowing the petitioner to live in peace and cases are foisted against the petitioner. The learned counsel further submitted that even if proceedings will have to be initiated under Section 110 Cr.P.C., summons will have to be issued to the petitioner.

In the considered view of this Court, the relief as sought for by the petitioner cannot be granted by this Court. If the petitioner feels that his personal liberty is violated and he is harassed by the Police, it is left open to the petitioner to work out his remedy before the Human Rights Commission and this Court cannot issue a omni-bus order directing the Police not to harass the petitioner. Such directions will ultimately tantamount to interfering with the investigation. 5.

This Criminal Original Petition is disposed of accordingly.
