This petition is filed under Article 226 of The Constitution of India praying to issue a writ of mandamus directing the 1st respondent to depute the higher officals to conduct enquiry with regard to mismanagement of ZA 114 Kangalacherry Primary Agricultural Coop. Credit Society, Kangalancherry, Nagpattinam Taluk & District by disposing the written representation made by the petitioner on 05.10.2015 within a stipulated time.

ORDER

Heard Mr.C.Prakasam, the learned counsel for the petitioner and Mr.D.Venkatachalam learned Government Advocate accepting notice for the respondents 1 to 3 and with the consent

of either side, the writ petition itself is taken up for final disposal at the admission stage.

2. The petitioner seeks for a direction upon the respondents to conduct an enquiry with regard to the alleged management of a Cooperative Society namely, ZA 114 Kangalacherry Primary Agricultural Coop. Credit Society, Kangalancherry, Nagpattinam Taluk & District. The petitioner would state that large scale misappropriation of the funds of the society has taken place and inspiteof, the several representations, both oral as well as in writing, no action has been taken by the respondents. On the contrary, the petitioner who was elected as Vice-President of the Society was removed from office.

3. In any event, the merits of the allegations made by the petitioner in the representation or in the affidavit filed in support of the writ petition, cannot be gone into at this stage, and it is for the authorities to take note of the same and act in accordance to law.

4. In the light of the above, the writ petition is disposed of by directing the 2nd respondent to consider the petitioner's representation dated 05.10.2015 on merits and in accordance with law and pass speaking order and communicate the same to the petitioner within a period of eight weeks from the date of receipt of a copy of this order.

5. The writ petition is dismissed with the above direction to the respondents. No costs.
