This petition is filed under Section 378(4) Cr.P.C, to grant special leave to file an appeal against the judgment dated 10.01.2023 passed by the learned Judicial Magistrate, Udhagamandalam, in S.T.C. No.651 of 2020.

2. Mr.M. Guruprasad, learned counsel for the petitioner contended that the learned Judicial Magistrate, Udhagamandalam, dismissed the complaint merely on the ground that the complainant did not appear before the court on the hearing date.

3. In the circumstances, there are some arguable points in the present appeal and accordingly, special leave is granted.

4. Registry is directed to number the Criminal Appeal, if it is otherwise in order, and list the matter for admission in the usual course. 13.07.2023 bga R.HEMALATHA, J.
