This petition is filed to condone the delay of 316 days in filing the above C.M.A against the judgment and decree dated 04.04.2022 in M.C.O.P.No.310 of 2018 on the file of the Subordinate Judge and Motor Accident Claims Tribunal, Perundurai.

2.Though notice have been served, none appeared on behalf of the respondents 1 and 2.

3.Ms.C.Bhuvanasundari, the learned counsel entered appearance for the third respondent.

4.Heard. Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed.

5.The Registry is directed to number the above C.M.A.SR.No.71213 of 2023, if the papers are otherwise in order.

6.It is underscored that in the eventuality of the appellants succeeding in the appeal to be taken on record, they would not be entitled to any interest for 316 days.
