Criminal Original Petition filed under Section 528 of BNSS, to direct the first respondent to transfer the investigation in Crime No.74 of 2020, dated 13.02.2020 on the file of the fifth respondent and entrust the same to the fourth respondent for investigation of the case by the competent officer and file a final report before he concerned Jurisdictional Magistrate.

ORDER

This Criminal Original Petition has been filed seeking a direction to the respondents to transfer the investigation in Crime No.74 of 2020, registered on 13.02.2020 under Section 174 Cr.P.C. by the fifth respondent police, to the fourth respondent for proper and effective investigation by a competent officer, and to file a final report before the jurisdictional court.

2. The learned Additional Public Prosecutor submitted that an Action Taken Report has already been filed before the learned XXIII Metropolitan Magistrate, Saidapet, in R.C.S.No.7 of 2025, 2 / 5

3. In view of the same, this Court is of the opinion that the petitioner may work out his remedies before the competent Magistrate. Accordingly, the learned XXIII Metropolitan Magistrate, Saidapet, is directed to issue summons to the petitioner and consider the Action Taken Report filed in Crime No. 74 of 2020, in accordance with law and on merits, after affording an opportunity of hearing to the petitioner.
