The learned counsel for the petitioner seeks liberty to withdraw the Civil Revision Petition with liberty to file a fresh application before the Trial Court invoking Order XXII of the Civil Procedure Code.

2. In view of the endorsement so made, the Civil Revision Petition is dismissed as withdrawn with liberty. No costs. Consequently, connected Civil Miscellaneous Petition is closed.

3. While computing the period of limitation, the Trial Court is directed to take note of the date on which I.A.No.115 of 2016 was filed by the petitioner, viz., 21.01.2016 and deduct the period of its pendency before the Trial Court.
