ORDER

The petitioner, who was arrested and remanded to judicial custody on 03.04.2026 for the offences punishable under Sections 75, 296(b), and 351(2) of the Bharatiya Nyaya Sanhita, 2023 (BNS) read with Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act (TNPHW) Act, in Crime No.104 of 2026 on the file of respondent police seeks bail. 2.The allegation against the petitioner is that on 31.03.2026 at around 2 pm, the petitioner has shown his private part by opening his pant zip to the women going through the street way. When they attempted to grab him, he threatened them and fled from the scene of occurrence. The petitioner was arrested and remanded to judicial custody on 03.04.2026.

3. The learned Counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner was illegally arrested and remanded to judicial custody on 03.04.2026. He further submitted that the petitioner is ready to co-operate with the investigation/trial process. Hence, he prayed for grant of bail to the petitioner.

Mr.V.J.Priyadarsana, learned Government Advocate (Criminal Side) appearing for the respondent police, reiterated the prosecution case and submitted that the petitioner by sitting in his motorcycle bearing Registration No. TN-05-CY-2428, opened his pant zip and showed his private part to the women, who were passing through the street and thereby harassed them. He further submitted that investigation is pending at the initial stage against the petitioner. Therefore, he opposed to grant bail to the petitioner. 5.Considering the nature of offence committed by the petitioner; that the investigation is at the initial stage; if bail is granted to the petitioner, similar offence would be occurred in the future, this Court is not inclined to grant bail to the petitioner.
