O R D E R

The respondent, by the impugned order dated 20.08.2013, dismissed the petitioner from service and challenging the same, the writ petitioner is before this Court.

2.According to the petitioner, though enquiry officer has been appointed and enquiry was conducted, no enquiry report was furnished. The writ petitioner has approached this Court on the simple ground that without furnishing the enquiry report, orders cannot be passed.

3.The learned Standing Counsel would fairly submit that the enquiry report will be furnished and will proceed with the enquiry in accordance with law.

4.In light of the submission of the parties concerned, the impugned order is set aside and remanded back to the concerned authority for conducting the enquiry afresh in accordance with law, after furnishing the copy of the enquiry report to the petitioner, as soon as possible within a period of twelve weeks from the date of receipt of the copy of this order. 5.In the result, this Writ petition is allowed. Consequently, connected miscellaneous petition is closed.
