PRAYER: Transfer Civil Miscellaneous Petition filed under Section 24 C.P.C of the Constitution of India, to withdraw the petition in O.P.No.2219 of 2016 pending on the file of the learned Principal Judge, Family Court, Madras and the same may be transferred to the Subordinate Court, Theni, Theni District where the H.M.O.P. No.165 of 2016 filed by the petitioner against the respondent herein is pending for hearing.

ORDER

By consensus of the parties, O.P.No.2219 of 2016 is withdrawn from the file of the learned Principal Judge, Family Court, Chennai and the same

is transferred to Sub Court, Theni, to be tried along with H.M.O.P.No.165 of 2016.

2. The respondent / husband is directed to pay a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) to the petitioner / wife, towards litigation expenses.

3. The learned Subordinate Judge, Theni, is directed to dispose of O.P.No.2219 of 2016 along with H.M.O.P.No.165 of 2016, within a period of three months from the date of receipt of a copy of this order.

4. With these observations, this Transfer Civil Miscellaneous Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
