... Respondents On representation of the learned counsel for both sides, this case is taken up for settlement before the Lok Adalat today. Both the parties are present. The learned counsel for the petitioners, Mr.M. Aravindan & Srividhya Aravindan and the learned counsel for the respondent, Mr. K. Kumar are present.
TERMS OF SETTLEMENT The petitioners are the borrowers in Civil Revision Petition and the Bank is the respondent.
2. This Civil Revision Petition is filed under Article 227 of the Consitution of India challenging the order passed by the Chief Metropolitan Magistrate in M.P. No.1439 of 2006 whereby the petitioners were directed to handover the possession of the premises mortgaged to the Bank, through the Advocate Commissioner appointed Chief Metropolitan Magistrate.
3. In the presence of both the parties and their respective counsel, the entire dispute was negotiated and finally it was settled, for which joint memo of compromise has also been filed, signed by both the parties and their respective counsel. Therefore, an award has to be passed in terms of the joint memo of compromise filed today before this forum. Award is accordingly passed. The joint memo of compromise shall form part of the award.
