ORDER
This Criminal Original Petition has been filed directing the trial Court viz. the District Munsif cum Judicial Magistrate Court, Tharangampadi to dispose of the case in CC.No.111 of 2020 within a time frame as may be fixed by this Hon'ble Court in accordance with merits and law.
2. The learned counsel for the petitioner submitted that the petitioner is a defacto complainant in C.C.No.111 of 2020 pending on the file of District Munsif cum Judicial Magistrate Court, Tharangampadi. After framing charges against the accused, there is no progress in the case. Not even a single witness is examined till date and the case is unnecessarily adjourned. Therefore, this petition.
3. In response, the learned Government Advocate (Crl.Side) submitted that the steps will be taken for production of witnesses and for their examination.
4. Considered the rival submissions and perused the records.
5. The list of witnesses shows that there only nine witnesses. The fact that from the year 2020, not even a single witness is examined shows that the Trial is not proceeded with the expected urgency and speed.
6. Therefore, this Court directs the District Munsif cum Judicial Magistrate Court, Tharangampadi to dispose of the case in C.C.No.111 of 2020
as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order.
7. Accordingly, this Criminal Original Petition is disposed of. 14.06.2023 Index:Yes/No Speaking/Non speaking order mn
