The petitioner herein alleging that the police is unnecessarily harassing him on the complaint given by his former client is before this Court seeking protection.

The petition is filed alleging that one Balasubramaniam @ Kallapuram Balu engaged the petitioner to represent his case and gave fees for it. Later since there was a misunderstanding, the petitioner had returned the fees. To wreak vengeance, a false complaint has been given against him. Based on the complaint, the police is harassing him for his appearance in person for enquiry.

The learned Government Advocate (Crl.Side) appearing for the respondent police states that the complaint has been registered in C.S.R.No.278 of 2024. The petitioner instead of appearing before the Investigating Officer had approached this Court alleging that the police is harassing. He further states that the petitioner was summoned to appear before the Investigating Officer for enquiry, but making vile allegations he has sent a letter to the higher officials and approached this Court for direction without submitting himself for enquiry in accordance with law.

Taking into consideration, the averments in the petition and the submissions made by the learned Government Advocate (Crl.Side), 2/4

this Court is of the view that it is suffice to dispose of this Criminal Original Petition with direction to the respondent police that if the presence of the petitioner is required in connection with C.S.R.No.278 of 2024, same can be proceeded by causing notice and record his statement without violating the law.
