O R D E R

This petition has been filed to quash the proceedings in M.C.No.4 of 2018 on the file of the Family Court, Puducherry. 2.Heard the learned counsel for the petitioner and perused the materials placed on record.

3.For the sake of convenience, the parties will be referred to by their name. Sasicala got married to Anantha Padmanabhan on 19.01.1997 and they have one child through the wedlock. Their marriage life ran into rough weather and they got estranged. Sasicala has initiated proceedings P.N.PRAKASH, J.

gya in M.C.No.4 of 2018 before the Family Court, Puducherry under Section 125 of Cr.P.C. claiming maintenance from Anantha Padmanabhan. Challenging which, Anantha Padmanabhan has filed this present quash petition.

4.Learned counsel appearing for Anantha Padmanabhan submitted that already the Sub Court has granted interim maintenance in I.A.No.301 of 1997 and that, Anantha Padmanabhan is paying a sum of Rs.3,000/- per month [Rs.1800/- for wife + Rs.1200/- for child].

5.In the opinion of this Court, a sum of Rs.3,000/- that is being paid by this petitioner is indeed a paltry amount, taking into consideration the cost of living index today. Hence, this petition is closed with liberty to Anantha Padmanabhan to raise the above aspect before the Family Court, so that in the event of the maintenance amount being determined, the Family Court can take into consideration the maintenance that is allegedly being paid by Anantha Padmanabhan to Sasicala.
