O R D E R

This writ petition has been filed for issue of a writ of mandamus directing the 1 st respondent to consider the representation made by the petitioner on 14.03.2025, wherein the petitioner has sought for initiating action against the nd respondent.

2. Heard Mr.M.N.Balakrishnan, learned counsel for the petitioner and carefully went through the materials placed before this Court.

3. It is seen that there is a private dispute between the petitioner and the nd respondent. According to the petitioner, he entered into a partnership and paid a sum of Rs.30Lakhs. Suppressing the partnership deed, the 2 nd respondent was attempting to transfer the business rights in favour of another person against the terms and conditions of the license issued by the 1 st respondent. That apart, the petitioner was also cheated by the 2 nd respondent to the tune of Rs.30Lakhs. It is under these circumstances, the representation came to be given to the st respondent.

4. In the considered view of this Court, there is a private dispute which cannot be resolved by the 1 st respondent. If at all, there is any violation of terms and conditions of license issued by the 1 st respondent, the 1 st respondent can always take action in accordance with law. That does not mean that the 1 st respondent is also vested with the power of resolving a private dispute between the parties. Therefore, no useful purpose would be served in issuing a direction to the st respondent.

This writ petition is disposed of with the above observation. No costs. 02.06.2025 Index : Yes/No gya 3/4
