ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence punishable under Section 417, 376, 506(i) of IPC, in Crime No.31 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant and the petitioner had love affair. Thereafter, the petitioner developed physical relationship with the defacto complainant and promised to marry her. However the petitioner refused to marry the defacto complainant. Hence, the complaint.

3.The learned counsel appearing for the petitioner submits that on an earlier occasion the defacto complainant filed a complaint in the law enforcing agency in CSR.No. 271 of 2020, in which there is no sexual allegations against the petitioner. He further submitted that the petitioner has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) submits that the the petitioner had sexual relationship with the defacto complainant and promised to marry. Thereafter he refused to marry the defacto https://hcservices.ecourts.gov.in/hcservices/

complainant. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.

5.Considering the facts and circumstances of the case and also the considering the gravity of the offence, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. -sd/- 14/09/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
