The instant writ petition has been filed seeking the relief of writ of Certiorarified Mandamus, calling for the records relating to the impugned order passed by the 2nd Respondent in Letter No.23122/sa1/ne.ma.ve.be/tha.aa.po.ka/kanchi/19 dated 17.02.2024 and quash the same as illegal and consequently direct the Respondents to revise and regularise the service seniority of the petitioner and give promotion with monetary benefits.

2. Heard Mr.A.Rajaram, learned counsel for the petitioner and Ms.S.Pavithra, learned Standing Counsel for Transport appearing for the respondents.

It is the submission of the learned Standing counsel for the respondents that there is a reference in the letter dated 17.02.2024 that a communication had sent to the petitioner on 23.07.2019 and 27.07.2019 in respect of imposing punishment against him. However, the learned counsel for the petitioner would submit that he has not received any communication and the narration in the impugned letter is factually incorrect. Therefore, the same has to be interfered with.

4. This Court does not find any merits in this writ petition, as the letter dated 17.02.2024 is only informing about the issuance of earlier letter. Whether it is factually correct or not cannot be gone into in the writ proceedings. However, as rightly contended by the learned counsel for the petitioner, he may be given liberty to challenge the orders dated 23.07.2019 and 27.07.2019 in accordance with law.

5. In view of the above discussions, this writ petition is dismissed. However, the petitioner is at liberty to challenge the orders dated 23.07.2019 and 27.07.2019 in accordance with law. There shall be no order as to costs. 03.06.2025 kmi Index : Yes /No Speaking order : Yes/No To
