Writ petition under Article 226 of the constitution of India praying for a writ of Mandamus directing the first respondent to dispose of the petition filed before them to initiate proceedings against the second and third respondents under secion 35 of the Advocates Act, till such time restrain the second and third respondents from appearing for the fourth respondent in CRP(PD) No.4097 of 2014.

JUDGMENT

(Judgment of the Court was delivered by T.RAJA, J.) Originally, writ petitioner/A.J.Mohammed Iqbal has filed W.P.No.29284 of 2014 seeking a direction to the first respondent/Bar Council of Tamil Nadu, to dispose of his petition dated 03.11.2014 requesting to initiate proceedings against the respondents 2 and 3 under Section 35 of the Advocates Act. Learned Single Judge, by order dated 17.11.2014, dismissed the said writ petition holding that the writ petitioner is not only guilty of abuse of process of Court in the conduct of the proceedings before the Wakf Tribunal but also guilty of attempting to remove an inconvenient counsel from appearing for his opponent. Aggrieved by the same, the writ petitioner has filed the present appeal.

2. No one represented on behalf of the writ petitioner/appellant.

Mr.H.Karthik Seshadri, learned counsel for the third respondent, submitted that the present appeal itself has become infructuous as the petition dated 03.11.2014 filed by the writ petitioner before the first respondent/Bar Council of Tamil Nadu, has already been considered and disposed on 24.07.2015, therefore, nothing survives for further adjudication in the present writ appeal.

4. Recording the submission of the third respondent that the petition dated 03.11.2014 of the writ petitioner has already been considered on 24.07.2015, the writ appeal is dismissed as infructuous.
