The petitioner, who apprehends arrest for the alleged offence under Sections 273, 328 of IPC U/s. 59 of Food Safety and Standards Act, 2006, U/s. 6(A), 24(1) of Cigarette and Other Tobacco Products Act, 2003 in Crime No.100 of 2024, on the file of the respondent police seeks anticipatory bail.

2.The case of the prosecution is that, on 15.04.2024, upon secret information, the respondent police went to the place of occurrence and found that petitioner and others were in possession of banned Tobaco products. Hence the complaint.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4.The learned Government Advocate (Crl.Side) submitted that petitioner along with others were illegally in possession of banned Tobacco T.V.THAMILSELVI, J.

dsn products weighing about 437 kgs. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of this case and quantity of tobacco products involved, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 13.06.2024 dsn 2/3
