When the criminal appeal is taken up for hearing, the learned counsel appearing for the appellant seeks permission of this Court to withdraw the criminal appeal and he has also made an endorsement to that effect.

However the appellant is at liberty to file an appeal before appropriate forum. The period spent for this appeal shall be exempted for the purpose of calculation of limitation.
