This petition is filed to condone the delay of 371 days in filing the appeal against the judgment and decree dated 14.12.2022 made in M.A.C.T.O.P.No.22 of 2021 on the file of the Motor Accident Claims Tribunal, Special District Court to deal with Motor Accident Claims Tribunal No.1, Tiruvallur.

2.First respondent remained ex parte before the Tribunal. Mr.K.Elango, the learned counsel entered appearance for the second respondent. 3.Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed. 4.The Registry is directed to print the name of the learned counsel for the second respondent in the cause list when the matter is listed for admission, and number the above C.M.A.SR.No.71396 of 2023, if the papers are otherwise in order.

Anu 5.It is underscored that in the eventuality of the appellants succeeding in the appeal to be taken on record, he would not be entitled to any interest for 371 days.
