C.M.P.No.12092 of 2023 in C.M.A.SR.No.55887 of 2022 J.NISHA BANU, J., and D.BHARATHA CHAKRAVARTHY, J., This petition has been filed to condone the delay of 157 days in paying the deficit court fee for a sum of Rs.24,000/- in the above C.M.A. as against the judgment and decree dated 21.12.2021, made in MACTOP No.5772 of 2017 on the file of the Motor Accident Claims Tribunal.

2. Heard the learned counsel for the petitioner as well as the respondent.

3. Considering the submissions made by the learned counsel for the petitioner, this Court is of the view that the delay may be condoned, however, on payment of costs. Accordingly, the delay is condoned on payment of cost of Rs.1,000/- (Rupees One Thousand only) payable by the petitioner to the Madras High Court Legal Aid Services Authority, Chennai, within a period of two weeks from today.

4. It is also made clear that if the cost is paid on or before 28.06.2023, and the affidavit of service is filed, this application stands allowed and the Registry is directed to number the main appeal, if it is otherwise in order.
