Writ Petition filed under Article 226 of the Constitution of India, praying for the issue of Writ of Mandamus directing the respondent to consider and admit the minor petitioner K.C.Varsheni for admission to the 1st year B.E/B.Tech Degree Course for the academic year 2019-2020 under the Schedule Tribe (ST) category.

Heard, the learned counsel for the petitioner and the learned Government Advocate for the respondent.

The petitioner herein sought for Community Certificate from the Revenue Divisional Officer that she belongs to Konda Reddi (Scheduled Tribe) Community and the request was rejected by the Revenue Divisional Officer, by order dated 31.08.2017. Against which, the petitioner has filed W.P.No.12351 of 2019 before this Court and the same is pending.

3. The petitioner seeks mandamus to direct the respondent to consider her representation that she belongs to Konda Reddi (ST) category and issue Community Certificate for admission to the https://hcservices.ecourts.gov.in/hcservices/

first year B.E/B.Tech Course for the Academic Year 2019-2020.

4. The respondent has filed counter affidavit stating that, the petitioner with out possessing ST Community Certificate seeks to be considered under the above category. Her request for ST Community Certificate rejected by the Revenue Divisional Officer after proper enquiry. The petitioner counsel in response, state that the parents of the petitioner have Community Certificate that they belongs to ST community, therefore it is a nature of corollary that, the petitioner also belongs to ST Community. Further the petitioner herein applied to get Community Certificate as Konda Reddi (ST). However, the Revenue Divisional Officer has rejected the claim and now the rejection order is subject matter of the Writ Petition.

5. In the said circumstances, the petitioner may be provisionally considered as ST community candidate for the purpose of Engineering College admission. If any admission made under the said category, it shall be subject to the outcome of the Writ Petition filed by the Petitioner. In any event, the petitioner fails to produce the ST Community Certificate before conducting the first year examination, the authority shall not permit her to take up her exams and shall have all rights to take further action.

6. With the above direction, this Writ Petition is disposed of. No costs. Consequently, the connected Miscellaneous Petition is also closed.
