JUDGMENT

(Judgment of the Court was made by R.SURESH KUMAR, J.) This intra-Court appeal has been directed against the order passed by the Writ Court dated 18.10.2023 made in W.P.No.22013 of 2021.

The present appellant was the writ petitioner, who participated in the selection process for selection and appointment to the post of Police Constable (Grade II), for which, notification was issued by the first respondent in Notification No.1/2019 dated 06.03.2019. After the selection process was over, since the appellant/writ petitioner secured only 68 marks, which does not come within the zone of consideration under his communal category of Scheduled Caste and also the special category of PSTM quota, he was not selected.

3. Questioning the non-selection, he moved the writ petition stating that, in respect of question Nos.42, 52 and 63, though he had written correct answers, marks have not been awarded to him. Had there been marks awarded for these three questions, his total marks would be 71 and not 68 and he would have come under the zone of consideration under his communal category of Scheduled Caste and special category of PSTM quota. This is the ground under which the writ petition was filed by the appellant/writ petitioner.

The learned Writ Court, having considered this aspect and having gone through the counter affidavit and the arguments advanced on behalf of the respondent Selection Authority, where since it has been stated that an Expert Committee has been constituted, who, after having gone through these kinds of objections raised by various candidates, including the appellant/writ petitioner, has given the expert opinion that, in respect of question Nos.42, 52 and 63, the appellant/writ petitioner has chosen to give only wrong answers, therefore, he is not entitled to get marks.

When that being the position, since the appellant/writ petitioner is not entitled to get those three marks, as for the said three questions he has chosen to give only wrong answers, the total marks secured by him is only 68 and since that 68 marks does not come within the zone of consideration for Scheduled Caste communal quota with PSTM special category, his candidature was not fit enough to be selected under the said quota and therefore, he was not selected. Having considered this aspect, the learned Writ Court rejected the writ petition through the impugned order dated 18.10.2023.

We are not impressed with the submissions made by the learned counsel appearing for the appellant/writ petitioner to show any indulgence against the said order, thereby, the order impugned is sustained and hence, the writ appeal is liable to be dismissed, accordingly, it is dismissed. However, there shall be no order as to costs.
