A.GOPINATH, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 392 of IPC in Cr.No.486 of 2021 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner along with the other accused have waylaid the defacto complainant and his friend and attacked them and robbed a sum of Rs.1500/- cash and a two wheeler. Based on the complaint lodged by the defacto complainant, the respondent police registered a case against the petitioner and other accused persons.
3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, the learned counsel prays to grant anticipatory bail to the petitioner.

4.The learned Government Advocate submitted that the petitioner is a habitual offender and further submitted that there are two previous cases pending against the petitioner and the stolen property has not been recovered from them.
5.Considering the fact that there are two previous cases pending against the petitioner and the subject property has not been recovered, this Court is not inclined to grant anticipatory bail to the petitioner.
