petitioner's representation dated 29.03.2026, seeking to conduct a detailed survey and resurvey of the petitioner's property in Survey No.880/3A2 and the adjoining property in Survey No.880/2A2, strictly in accordance with the original field measurement book (FMB) records and to identify and fix the correct boundaries, restore and re-establish the boundary stones in their original position, rectify the errors in the computerized FMB records, within a time frame to be fixed by this Court.

ORDER

This writ petition has been filed seeking to direct the respondents to conduct a survey and fix the boundaries of the petitioner's property comprised in Survey No.880/3A2 and the adjoining property in Survey No.880/2A2, strictly in accordance with the original field measurement book (FMB) records. 2.Learned counsel for the petitioner made a representation dated 29.03.2026, before the respondents seeking to survey and demarcate the property morefully described in the prayer to this writ petition. Since the same was not considered by the respondents, the present writ petition has been filed.

3.Mr.M.Guruprasad, learned Government's Counsel, who accepts notice on behalf of the respondents would submit that the petitioner's representation dated 29.03.2026 will be considered and disposed of within a time frame to be fixed by this Court.

4.Heard the learned counsel for the petitioner as well as the learned Government's Counsel appearing for the respondents. 5.Considering the submissions made by both parties and in view of the limited prayer sought for in this writ petition, this Court without expressing any opinion on the merits of the case, directs the respondents 2 and 3 to consider the petitioner's representation dated 29.03.2026 and conduct a survey and demarcate the subject properties, in accordance with the original field measurement book (FMB) records, within a period of twelve (12) weeks from the date of receipt of a copy of this order, after issuing prior notice to the petitioner and other parties concerned, if any. If any need arises for Police assistance, it is open to the respondents 2 and 3 to request for Police protection from the jurisdictional Police. If any such request is made, the jurisdictional Police is directed to provide an adequate Police protection for conducting the survey.

6.It is made clear that this order is passed only for the purpose of issuing a direction to the respondents 2 and 3 to conduct survey and to demarcate the subject property. In the event any dispute arises regarding the possession of the subject property, the same has to be decided by way of filing a suit before the competent Civil Court.
