ORDER

This Writ Petition has been filed for the following reliefs:- "to call for the records pertaining to the impugned suspension order in Ref.No.7416/2025/A3 dated 11.11.2025 on the file of the respondent no.2 and quash the same as illegal and consequently directing the respondent no.2 to revoke the suspension and reinstate the petitioner in the post of village administrative officer in light of the guidelines issued G.O.Ms.No.81 (Human Resources Development) dated 04.08.2022 within the time stipulated by this Hon'ble Court."

Brief Facts:-

2. The petitioner would submit that she was appointed as a Village Administrative Officer on 15.07.2017 and, at the time of her suspension, was serving as the Village Administrative Officer of P. Vadugapalayam Village.

3. The petitioner submits that, while serving as the Village Administrative Officer of P. Vadugapalayam Village, a false complaint was lodged by one Mr.Krishnasamy before the Vigilance and Anti-Corruption Department, alleging that the petitioner had demanded illegal gratification. Pursuant to the said complaint, an FIR in Crime No. 11 of 2025, dated 09.11.2025, was

registered against the petitioner.

4. The petitioner would submit that she has neither demanded nor accepted any illegal gratification and that the allegations levelled against her are false and untenable. The petitioner would further submit that, on the basis of the registration of the FIR, the second respondent placed her under suspension by proceedings dated 11.11.2025. Thereafter, no departmental enquiry has been conducted till date.

5. The Petitioner would submit that she has been under prolonged suspension without any progress in the departmental proceedings. Therefore, the petitioner had submitted a representation dated 18.03.2026 seeking revocation of suspension. However, the said representation has not been considered by the Respondents to date. Therefore, the petitioner is before this Court, seeking the reliefs stated supra.

6. The learned counsel for the petitioner submitted that it would suffice if this Court directs the 2nd respondent to consider the representation of the petitioner dated 18.03.2026, seeking revocation of suspension within a fixed time frame.

7. Heard the learned counsel on either and perused the records.

8. Though this Writ Petition has been filed for the reliefs stated supra, considering the submissions made by the learned counsel for the petitioner and in the absence of any serious objection from the learned counsel appearing for respondents, this Writ Petition is disposed of. The 2nd Respondent is directed to consider and pass orders on the petitioner's representation dated 18.03.2026 seeking revocation of suspension, in accordance with the instructions issued by the Government in G.O.Ms.No.81, Human Resources Management (N) Department, dated 04.08.2022 and in the light of the dicta laid down by the Hon'ble Supreme Court in the case of Ajay Kumar Choudhary Vs. Union of India reported in (2015) 7 SCC 291, within a period of eight weeks from the date of receipt of a copy of this order. No costs. Consequently, the connected Miscellaneous Petitions are closed.
