Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the respondent to dispose of the appeal filed by the Petitioner dated 24.12.2012 after providing an opportunity of hearing to all the concerned parties within a time to be fixed by this Court.

ORDER

By consent, the writ petition is taken up for final disposal. The petitioner would claim that he has purchased a property admeasuring to an extent of 00207 sq.meter in Old Survey No.7/3 part T.S.No.24, Hanumanthaputheri, Chengalpattu Taluk, Kancheepuram District, vide registered Sale Deed dated 17.06.2011. It is stated by the petitioner that the patta originally stood in the name of the vendor and after verifying the encumbrance only, he had purchased the said property and it is also classified as Natham House site and patta was also granted to the predecessors in title. The petitioner, after purchase, has mutated the revenue records and patta was also transferred in his name and is also having water supply and electricity service connection. All of a sudden, the patta was transferred in the name of one K.S.

Venkataraman, vide order dated 27.11.2012 by the Tahsildar, Chengalpattu. According to the petitioner , the said order came to be passed in terms of the order dated 14.03.2012 made in WP.No.44596/2012 and the order dated 12.12.2011 made in Contempt Petition No.6504/2011. https://hcservices.ecourts.gov.

The petitioner aggrieved by the said order, transferring the patta in favour of the said K.S.Venkataraman, filed a statutory appeal before the respondent on 24.12.2012 and despite very many personal representations, the appeal is yet to be taken up for hearing and therefore, the petitioner came forward to file this writ petition.

3 Heard the learned counsel for the petitioner and Mr.P.Sanjay Gandhi, learned Additional Government Pleader, who accepts notice on behalf of the respondent.

4 This Court, taking into consideration the limited scope of prayer sought for the petitioner and without going into the merits of the same, directs the respondent to dispose of the petitioner's appeal dated 24.12.2012 on merits and in accordance with law, after putting on notice Mr.K.S.Venkataraman and pass orders within a period of six weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner as well as to Mr.K.S.Venkataraman. 5 The writ petition is disposed of with the above direction. No costs.
