C.M.P.No.14573 of 2018 in S.A.(No).SR.16383 of 2018 P.T. ASHA, J, The above application is filed for condoning the delay of 774 days in filing the above Second Appeal.

2.The reasons which have been given for the delay is utter poverty of the appellant to eke out her livelihood by working as a labourer in the National Rural Job Assurance Scheme and therefore, unable to raise funds to file the appeal.

3.The counter has been filed denying the said reasons.

4.Considering the fact that the affidavit has been sworn by the parties and the suit is one for bare injunction where the respondent is succeeded in both the Courts, the delay is condoned and this petition is allowed.
