This original petition has been filed taking advantage of Section 372 of the Indian Succession Act, 1925 seeking Succession Certificate with respect to the debts in the name of D.Shanthi, who died on 28.11.2022. The details of the debts had been given in the schedule to the petition. 2.The petitioners are the sisters of the deceased D.Shanthi. The husband of the deceased, V.Balasubramani had predeceased her. They had no children. The parents also died. The petitioners therefore claimed that they are the only Class-II legal heirs to survive their sister D.Shanthi. They claimed that the deceased D.Shanthi was working as cleaner in Tamil Nadu Slum Clearance Board and later, she was transferred to the Greater Chennai Corporation as permanent worker. She had a bank account in Indian Overseas Bank, Washermenpet Branch and also a LIC policy. 3.

After following due procedure, the petitioners were invited to tender evidence. Accordingly, the 1st petitioner was examined as PW-1 and Exs.P1 to P11 had been marked. Exs.P1, P2 and P7 are the documents relating to the LIC policy and the Bank Account. Exs.P4 and P5 are the Death Certificates of V.Balasubramani and D.Shanthi respectively. https://www.mhc.tn.gov.

smv 4.The learned counsel for the petitioners stated that the petitioners were not able to get Legal Heirship Certificate, owing to the position in which they were placed, particularly as the said D.Shanthi was working as a cleaner in the Greater Chennai Corporation.

5.In view of the evidence adduced, this Original Petition stands allowed. The Succession Certificate may be issued in favour of the petitioners in accordance with the rules.
